1 Acceptance of Terms

By accessing or using Mass Email PRO ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Mass Email PRO.

2 Description of Service

Mass Email PRO is a browser-based bulk email sending tool that allows users to:

• Connect a Gmail account via Google OAuth 2.0 or configure a custom SMTP server
• Upload contact lists in Excel (.xlsx, .xls) or CSV format
• Compose personalized email campaigns using dynamic variables
• Send emails to a list of recipients with configurable delays and attachments

The Service is provided free of charge. No account registration is required.

3 Acceptable Use

You agree to use Mass Email PRO only for lawful purposes and in a manner that does not infringe the rights of others. Acceptable use includes:

• Sending newsletters to subscribers who have opted in to receive communications
• Professional outreach to contacts with whom you have a legitimate business relationship
• Internal company communications
• Transactional emails (order confirmations, notifications)

4 Prohibited Activities

You must not use the Service to:

• Send spam, unsolicited bulk emails, or emails to recipients who have not opted in
• Harass, threaten, or harm any individual or group
• Distribute malware, phishing content, or fraudulent material
• Violate any applicable local, national, or international law or regulation
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any system or network
• Use the Service for any commercial spam operation

5 Email Compliance

You are solely responsible for ensuring that your email campaigns comply with all applicable laws and regulations, including but not limited to:

• CAN-SPAM Act (USA): Include a valid physical address, clear identification as an advertisement (if applicable), and a working unsubscribe mechanism.
• GDPR (European Union): Obtain explicit consent from recipients in the EU before sending marketing emails. Honor opt-out requests promptly.
• CASL (Canada): Obtain express or implied consent before sending commercial electronic messages to Canadian recipients.
• SMTP / Gmail Terms: Comply with the terms of service of your chosen email provider (Google, Microsoft, etc.).

Mass Email PRO is a tool and does not verify your compliance. You bear full responsibility for how you use it.

6 Google OAuth Usage

When using Google OAuth to connect your Gmail account, you additionally agree to:

• Google's Terms of Service
• Google Workspace Acceptable Use Policy
• Google API Services User Data Policy

You are responsible for your use of the Gmail API through this Service and must comply with Google's sending limits and policies.

7 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8 Limitation of Liability

To the fullest extent permitted by applicable law, Mass Email PRO and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost profits, or business interruption, arising out of or relating to your use of the Service. Our total liability shall not exceed zero dollars ($0), as the Service is provided free of charge.

9 Account Termination

We reserve the right to restrict or terminate access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, third parties, or the reputation of the Service.

10 Changes to Terms

We may modify these Terms of Service at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new terms. We encourage you to review these Terms periodically.
